Terms of Service

As a charity choosing to participate and collaborate as a benefitting partner, Fayette Gives requires that you agree with the following Terms of Service which sets forth the services and duties provided by Fayette Gives and the Community Foundation of Fayette County and roles and responsibilities of all participants.

  1. I confirm that my charity is a 501(c)3 and 509(a) nonprofit eligible to receive tax-deductible gifts and will provide our EIN number, contact info, and a representative’s information for verification. I understand that my charity will be required to provide our 990 Form, as most recently filed. I confirm that my charity will complete our registration profile with accuracy to the best of our knowledge and belief.
  2. I understand that as the administrator of my charity's profile on GiveGab, it is my responsibility to grant (authorize) and revoke (unauthorize) administrative capabilities to other individuals within my charity. I understand that I can choose to allow them full administrative privileges or restrict their ability to view donor data within our charity. I understand that GiveGab will not disclose information about my charity to individual users unless those users are administrative users with appropriate permissions.
  3. I confirm that my charity serves Fayette County and that my charity will use all monies that are raised through Fayette Gives to benefit Fayette County.
  4. I understand that my charity will receive all the monies that have been donated to my charity less any fees not covered by the individual donor. Fees include a platform fee, a credit card fee, and a transaction fee.
  5. I understand that my charity is encouraged to promote Fayette Gives leading up to and throughout the event to create a sense of excitement among staff, board of directors, donors, volunteers, media partners, and fellow charities.
  6. I understand that the Community Foundation of Fayette County, host of Fayette Gives, is not responsible for the amount of money contributed to my charity over the course of the event. I understand that donors choose where to place their gifts and that the Community Foundation of Fayette County has no control of this process.
  7. I understand that GiveGab.com is an online platform which will safely process all contributions made to the event.
  8. I understand that all donations will be disbursed to charities, by December 31 of the Fayette Gives day’s current year, via ACH electronic transfer minus transaction fees.
  9. I understand that each Fayette Gives donation must be directly from an individual donor or business and that collected donations are not accepted (such as a donation jar in the office to which multiple people add money and is submitted as one Fayette Gives donation).
  10. I understand that each prize has requirements and limitations and that there are rules for Fayette Gives prizes. I understand that some prize winners are selected at random and other prize winners are determined by defined criteria, all in an effort to incentivize donors and increase engagement. I understand that prize winners chosen on the day are subject to further verification and may be finalized after the event.
  11. I understand that a charity’s prize money may not exceed the amount of their donations at the end of the Fayette Gives day. If a charity’s total amount of donations for Fayette Gives is less than their prize total, they will be awarded only a matching amount of prize money and the remaining prize amount will be forfeited.
  12. I understand that, to receive Fayette Gives monies, it is my charity's responsibility to provide a checking account that is eligible to receive ACH transfers from the Community Foundation of Fayette County and to provide written notification of changes to the bank account information, when applicable, in a timely manner.
  13. I understand that it is the responsibility of the donor to review their Fayette Gives donation for accuracy and that all donations are final. I understand that the Community Foundation of Fayette County has the discretion to refuse a donation.
  14. I confirm that my charity will not use any Fayette Gives donation as a quid pro quo contribution, meaning a payment made partially as a contribution and partially for goods or services provided to the donor or by the receiving charity (such as payments for sponsorships, event registrations, membership dues, etc.) I understand that all Fayette Gives donations are fully tax-deductible and will be recorded as gifts to the Community Foundation of Fayette County.
  15. I understand that the Fayette Gives website may contain links to third-party websites or services that are not owned or controlled by the Community Foundation of Fayette County. I understand that the Community Foundation of Fayette County has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. I further acknowledge and agree that the Community Foundation of Fayette County shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
  16. I understand that the Community Foundation of Fayette County reserves the right, at their sole discretion, to modify or replace these Terms of Service at any time.
